The Sandiganbayan’s recent ruling acquitted Janet Lim Napoles and a former lawmaker of plunder charges, but they were found guilty of corruption related to the misuse of the Priority Development Assistance Fund (PDAF). Napoles was convicted on nine counts of corrupting a public official, while former Apec party-list representative Edgar Valdez was found guilty of nine counts of direct bribery. Both individuals received prison sentences of up to six years and fines totaling nearly P27 million.
Napoles was widely believed to be the mastermind behind the PDAF, or pork barrel scam, in which several lawmakers were accused of misappropriating funds intended for small-scale infrastructure or community projects. The scheme, exposed in 2013, involved the allocation of funds to fictitious projects ostensibly managed by Napoles’ companies. These funds were channeled through nonexistent foundations and fake non-governmental organizations supposedly affiliated with the JLN Group of Companies, Napoles’ holding company.
Employees of Napoles were named as incorporators or directors of these foundations and NGOs, each serving as the supposed recipient of a specific legislator’s PDAF. Some lawmakers were reported to have received substantial kickbacks for redirecting their pork barrel funds to Napoles’ NGOs.
It’s important to note that the Supreme Court had previously ruled that the PDAF was unconstitutional.
